  • Georgia Marijuana Laws

    Although the prohibition on Marijuana appears to be losing strength throughout the country, Marijuana in almost every form is still illegal in Georgia, and local law enforcement and prosecutors do not care if you are the last casualty in the failed war on drugs.  The potential punishments are harsh:

    • possession of less than one ounce is a misdemeanor punishable by up to one year in jail and up to a $1,000.00 fine;
    • possession of greater than one ounce is a felony punishable from 1-10 years in prison;
    • possession with intent to distribute and cultivation each is a felony, depending on quantity, is punishable by a minimum from 1-15 years and up to 10-30 years in prison and a fine from up to $100,000.00 to $1,000,000.00;
    • aggravating factors (sale in school zone, housing project, and/or drug free zone; repeat offender) can significantly increase punishment;
    • other effects can be a driver's license suspension and loss of school financial aid

  • Recent Marijuana Case Results

    State v. N.B. Cobb County - 2015 - Misdemeanor Marijuana (2nd); RESULT: Negotiated Conditional Discharge; criminal record will be sealed.

    State v. M.B. DeKalb County - 2014 - Misdemeanor Marijuana;

    RESULT: Diversion Program in State Court after failed diversion in Municipal Court; case dismissed and criminal record sealed.

    State v. D.C. Cobb County - 2014 - Misdemeanor Marijuana (not eligible for diversion due to prior arrests); RESULT: Negotiated diversion with Solicitor General; case will be dismissed and criminal record will be sealed.

    State v. T.G. Cobb County - 2014 - Marijuana Cultivation;

    RESULT:  Reduced to Misdemeanor Marijuana.

    State v. D.D. Gwinnett & DeKalb Counties - 2014 - Misdemeanor Marijuana (2 charges at same time); RESULT: Diversion Program and Conditional Discharge; cases dismissed and criminal record sealed.
